Licence Agreement Free MapTP AJAX API (03/07)

This Licence Agreement applies between NAVTEQ (DE) GmbH (NAVTEQ (DE)) and any User of the Free MapTP AJAX API (the API). For further details of the functionalities currently provided by the Free MapTP AJAX API, please view the Product Description. The use of the Free MapTP AJAX API is only permitted when the User complies in all aspects with this Licence Agreement. Usage right NAVTEQ (DE) grants the User the right to use the Free MapTP AJAX API (the API), as is, free of charge. NAVTEQ (DE) reserves the right to (i) modify or alter the functions of the Free MapTP AJAX API at any time at its sole discretion without any prior notification to the User, (ii) terminate the permission of use generally or in any individual case at any time for any reason at the free discretion of NAVTEQ (DE), and (iii) make further requests of any User and, in the event of non-compliance, discontinue the API. Usage limitation The usage of the Free MapTP AJAX API is limited to 10,000 sessions and to 10,000 transactions per User within 24 hours. The 24 hours time frame starts at midnight CET. A session means the authentication of an application with the Free MapTP Application Key. A transaction is counted but not limited to every geocode, routing, or local search request. The transaction limit refers to the sum of all requests within 24 hours. In the event of reaching either the session or the transaction usage limit access for the User will be blocked until midnight CET. Existing sessions and transactions will be stopped. The User will be notified of this event by an automated email. In cases of repeatedly abusing the Usage Limitations NAVTEQ (DE) may block access for the User permanently. Advertisement NAVTEQ (DE) can, at its discretion, insert advertisements of any kind into the maps of the Free MapTP AJAX API, and the User will, in no way, insert content onto the User's website that may be in contradiction with, refer to, or comment on such advertisement on the API. Terms It is permitted to use the Free MapTP AJAX API only on a public, non password-protected, freely accessible, commercial or non commercial website on the internet (Permitted Use). The following use, functions, or changes of the API are prohibited (Prohibited Use): Any form of use of the API on a password-protected website, closed website, registered user group website, within a software application (web-based or standalone), intranet-page, or any website which contains illegal, harassing, pornographic, or politically radical content The display of positions and movements of vehicles, persons, or any other objects with the Free MapTP AJAX API resulting from the calculation of the position using technical systems such as, but not limited to, Global Positioning Systems (GPS), Gyroscopes, Radar sensors, Cell-IDs of mobile devices, or similar technology. Geocodes, route descriptions and/or -geometry or any other information that are determined or calculated with the Free MapTP AJAX API may only be used in combination with the components of the Free MapTP AJAX API. The use thereof outside of the Free MapTP AJAX API is prohibited Any change of the Free MapTP AJAX API that goes beyond the possibilities provided in the MapTP Administration Area or the documentation. In particular, manipulation or copying the code of the Free MapTP AJAX API in any way is prohibited. The usage of the maps and other data of the API in any form other than as stated in the Permitted Use. This includes, without being limited to, the prohibition of (i) copying of the maps by creating screen shots or other forms of duplication, (ii) any deletions, amendments, or partial or complete invisibility of any trademarks, copy-right notes, EULAs, or similar data, (iii) any deletions, amendments, or partial or complete invisibility of any maps, data, or advertisement inserted on the maps or other parts of the API by NAVTEQ (DE). Free MapTP AJAX API Application Attribution Applications developed with the Free MapTP AJAX API are attributed with copyright information, a Map24-logo, and a link to the Terms of Use. It is not allowed to alter the content of the delivered application. It is especially forbidden to alter the application in a way that the copyright information, the Map24-logo, or the link to the Terms of Use is removed or hidden in any way, shape or form. Liability Apart from deliberate damaging action, NAVTEQ (DE) is, in addition to the limitations of liability set forth in NAVTEQ (DE)'s General Terms and Conditions, in no way liable to the User for (i) any defect of the API, (ii) any lack of expected performance or functionality of the API, even if mentioned in the Product Description, (iii) imprecision or mistakes in the map material, or (iv) any additional work or efforts the User incurs as a result of any amendment to the API or its functions. In no event is NAVTEQ (DE) liable to the User for consequential or indirect damages or lost profits in any way. The User is liable towards NAVTEQ (DE) and will hold NAVTEQ (DE) indemnified at all times from third party claims relating to any infringement with third parties' rights on the website of the User, in which the Free MapTP AJAX API was used, or any other damage of NAVTEQ (DE) that may result from any infringement by the User or the User's website with the law, this Licence Agreement, or the General Terms and Conditons of NAVTEQ (DE). In addition, NAVTEQ (DE)'s General Terms and Conditions apply. This Licence Agreement and the General Terms and Conditions of NAVTEQ (DE) are hereby accepted.
